Terms & Conditions

These Terms and Conditions ("Terms") govern the use of services provided by Pixel Media ("we", "us", "our"). By engaging in our services or accessing our website, you ("the Client") agree to be bound by these Terms. These Terms are governed in accordance with the laws of the Republic of South Africa.

1. Services

Pixel Media provides digital marketing services including but not limited to:

  • Facebook & Instagram Advertising (Meta Ads)

  • Traffic, Awareness, Leads & Sales Campaigns

  • Graphic Design

  • Ad Management

  • Campaign Strategy

  • Content Marketing

A detailed scope of work will be provided upon proposal or quotation.

2. Bookings and Payment Terms

  • All services must be booked in writing (email, WhatsApp, or website form).

  • Full payment is required before work commences unless otherwise agreed upon in writing.

  • Invoices are payable within 3 working days of issue.

  • Delays in payment may result in postponed campaign start dates or project delivery.

  • All prices include VAT where applicable.

3. Design & Ad Work

  • All creative work remains the intellectual property of Pixel Media until full payment is received.

  • Pixel Media reserves the right to showcase any completed work in our portfolio or for marketing purposes, unless otherwise agreed upon in writing.

  • Final design files will be provided in formats agreed upon during briefing.

  • Up to two rounds of revisions are included per design. Additional revisions will be quoted separately.

4. Cancellations and Refunds

  • Cancellations must be received in writing at least 5 working days prior to the project start date.

  • No refunds will be issued once the campaign or design work has started.

  • If a campaign is cancelled after planning has begun but before deployment, a 50% cancellation fee applies.

  • If Pixel Media cannot fulfil services due to unforeseen circumstances, a full or partial refund may be issued, based on work already completed.

5. Client Responsibilities

The client agrees to:

  • Provide accurate and complete information necessary for project execution.

  • Approve and sign off designs, content, and campaigns within a reasonable time.

  • Supply logos, brand guidelines, and any third-party material in agreed formats.

  • Ensure compliance with the South African Advertising Standards Authority (ASA) and relevant Facebook/Meta advertising policies.

6. Performance Disclaimer

  • Pixel Media does not guarantee specific results, such as sales volume or lead quality, as these depend on many variables outside our control (including market behaviour, competition, and budget).

  • Performance metrics such as click-through rates and impressions will be monitored and optimised as part of our ongoing service.

7. Confidentiality

Pixel Media respects the confidentiality of client data, strategies, and campaigns. No information will be shared with third parties without the client’s written consent, except where required by law.

8. Privacy

Pixel Media complies with the Protection of Personal Information Act (POPIA). Please refer to our [Privacy Policy] for full details on how we handle data.

9. Limitation of Liability

Pixel Media will not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to our services. Our total liability will not exceed the amount paid by the client for the services in question.

10. Waitlists & Scheduling

  • In cases where services are in high demand, clients may be added to a waitlist.

  • Project slots are secured only upon receipt of full payment.

11. Amendments

Pixel Media reserves the right to update or change these Terms at any time. Changes will be effective upon posting to our website. Continued use of services after changes implies acceptance of the updated Terms.
